Privacy policy for the LUBING TikTok channel

  1. Information about TikTok channel LUBING_de

LUBING Maschinenfabrik Ludwig Bening GmbH & Co. KG (hereinafter referred to as “LUBING”) uses the technical platform and services of TikTok Technology Limited, 10 Earlsfort Terrace, Dublin, D02 T380, Ireland (hereinafter referred to as “TikTok”) for the LUBING channel offered.

LUBING has deactivated the TikTok Analytics function for the TikTok channel LUBING_de (handle: @ LUBING_de; hereinafter “LUBING channel”). This means that TikTok does not provide LUBING with page statistics that provide anonymized information about visitor groups and visitor activities. The so-called “TikTok Analytics Joint Controller Addendum” therefore does not apply to this LUBING channel.

In the following, LUBING informs you in accordance with Art. 13 of the General Data Protection Regulation (GDPR) about the manner and background of the processing of your personal data by LUBING via the LUBING channel and about the rights to which you are entitled in this respect.

If TikTok processes personal data when you visit the LUBING channel (e.g. your IP address and other information that is stored on your end device, e.g. in the form of cookies), TikTok alone is responsible for this under data protection law (see under 9.). LUBING is not responsible for data processing by TikTok under data protection law. There is no joint responsibility with LUBING within the meaning of Art. 26 GDPR.

4 Data processing by LUBING in connection with interactions on this LUBING channel

If you comment on, share or otherwise react to one of the posts on the LUBING channel, LUBING processes personal data. This includes your TikTok user data (in particular display name, user name, profile picture), the content of the comments you have made and the related metadata (in particular the date on which you posted the respective comment). If you also follow the LUBING channel of LUBING on TikTok, LUBING also processes this information.

In addition, LUBING may store the above-mentioned data if and as long as this is necessary for legal proceedings or to fulfill retention obligations.

 

5 Purpose of LUBING’s data processing

LUBING processes this data for the purpose of targeted public relations work. LUBING sees social media, including this LUBING channel, as a contemporary extension of public relations work, with which it is possible to inform customers about the activities, projects and goals of LUBING.

This LUBING channel and the associated data processing by LUBING enable a direct and fast exchange with the users.

 

6 Legal basis for data processing by LUBING

The legal basis for the processing of data by LUBING is Art. 6 para. 1 lit. f GDPR and, if users have given their consent, Art. 6 para. 1 lit. a GDPR.

If personal data relating to you is processed, you have the right to information, correction, deletion and transferability of the data and to restriction of processing in accordance with the GDPR.

If LUBING processes your personal data to protect a legitimate interest (Art. 6 para. 1 lit. f GDPR), you can object to the processing. The cases in which LUBING bases the processing on this can be found in this privacy policy.

To assert your right to object and the other rights of data subjects, you can contact LUBING or its data protection officer with regard to the data processing described under 4 (by e-mail, see contact details above).

If you exercise your right to object, please explain the reasons why your personal data should not be processed. In the event of your justified objection, the situation will be examined and the data processing will either be discontinued or adapted to it or you will be shown the compelling legitimate grounds on the basis of which the processing will be continued.

According to its own statements, TikTok stores data for as long as is necessary for the provision of the platform and for the other purposes stated in TikTok’s privacy policy.
